Terms and Legal Bases<\/h2>\n\n<h3 id=\"begriffe\">2.1 Terms<\/h3>\n\n<p><strong>Personal data<\/strong> is any information that relates to an identified or identifiable person. A <strong>data subject<\/strong> is a person about whom personal data is processed.<\/p>\n\n<p><strong>Processing<\/strong> includes <em>any<\/em> handling of personal data, <em>regardless<\/em> of the means and procedures used, in particular the storage, disclosure, procurement, collection, deletion, storage, modification, destruction and use of personal data.<\/p>\n\n<p>The <strong>European Economic Area (EEA)<\/strong> comprises the member states of the European Union (EU) plus the Principality of Liechtenstein, Iceland and Norway. The General Data Protection Regulation (GDPR) refers to the processing of personal data as processing of personal data.<\/p>\n\n<h3 id=\"rechtsgrundlagen\">2.2 Legal Basis<\/h3>\n\n<p>We process personal data in accordance with Swiss data protection law such as, in particular, the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/cc\/1993\/1945_1945_1945\/de\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" id=\"65293\">Federal Data Protection Act<\/a> (FADP) and the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/cc\/1993\/1962_1962_1962\/de\" rel=\"nofollow noopener\" target=\"_blank\">Ordinance to the Federal Data Protection Act<\/a> (FDPA).<\/p>\n\n<p><span id=\"dsgvo\">We process - if and to the extent that the General Data Protection Regulation (GDPR) is applicable - personal data in accordance with <em>at least<\/em> one of the following legal bases:<\/span><\/p>\n\n<ul>\n<li><a href=\"https:\/\/steigerlegal.ch\/dsgvo\/dsgvo-6\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6 par. 1 lit. b GDPR<\/a>  for the necessary processing of personal data for the fulfillment of a contract with the data subject as well as for the implementation of pre-contractual measures.<\/li>\n<li>Art. 6 par. 1 lit. f DSGVO for the necessary processing of personal data to protect the legitimate interests of us or of third parties, unless the fundamental freedoms and rights and interests of the data subject prevail. Legitimate interests are, in particular, our interest in being able to provide our offer permanently, in a user-friendly, secure and reliable manner, as well as to be able to advertise for it as required, information security as well as protection against misuse and unauthorized use, the enforcement of our own legal claims and compliance with Swiss law.<\/li>\n<li>Art. 6 par. 1 lit. c GDPR for the necessary processing of personal data to comply with a legal obligation to which we are subject under any applicable law of Member States in the European Economic Area (EEA).<\/li>\n<li>Art. 6 par. 1 lit. e GDPR for the necessary processing of personal data for the performance of a task carried out in the public interest.<\/li>\n<li>Art. 6 par. 1 lit. a GDPR for the processing of personal data with the consent of the data subject.<\/li>\n<li>Art. 6 par. 1 lit. d GDPR for the necessary processing of personal data to protect vital interests of the data subject or another natural person.<\/li>\n<\/ul>\n\n<h2 id=\"art-umfang-zweck\">3. Nature, Scope and Purpose<\/h2>\n\n<p>We process those personal data that are <em>necessary<\/em> to provide our offer permanently, user-friendly, secure and reliable. In particular, such personal data may fall into the categories of inventory and contact data, browser and device data, content data, meta or marginal data and usage data, location data, sales data, contract data and payment data.<\/p>\n\n<p>We process personal data for the <em>period of<\/em> time necessary for the relevant purpose(s) or as required by law. Personal data whose processing is no longer necessary is anonymized or deleted. Persons whose data we process <em>generally<\/em> have the right to have their data deleted.<\/p>\n\n<p>We may have personal data processed <em>by third parties<\/em>. We may process personal data jointly with third parties or transfer it to third parties. Such third parties are, in particular, specialized providers whose services we use. We also ensure appropriate data protection with such third parties.<\/p>\n\n<p>We process personal data  <em>basically<\/em>  only with the consent of the data subject, unless the processing is permitted for other legal reasons, for example, for the performance of a contract with the data subject and for corresponding pre-contractual measures, to safeguard our overriding legitimate interests, because the processing is evident from the circumstances or after prior information.<\/p>\n\n<p>In this context, we process in particular information that a data subject <em>voluntarily and personally<\/em> provides to us when contacting us - for example, by mail, e-mail, instant messaging, contact form, social media or telephone - or when registering for a user account. We may store such information, for example, in an address book or with comparable tools. If you transfer personal data to us via third parties, you are obligated to ensure data protection vis-\u00e0-vis such third parties as well as to ensure the accuracy of such personal data.<\/p>\n\n<p>We also process personal data that we receive from third parties, obtain from publicly available sources or collect in the course of providing our services, if and to the extent that such processing is permitted for legal reasons.<\/p>\n\n<h2 id=\"ausland\">4. Personal Data Abroad<\/h2>\n\n<p>We <em>process<\/em> personal data in Switzerland and in the European Economic Area (EEA). However, we may also export or transfer personal data to other countries, in particular in order to process it or have it processed there.<\/p>\n\n<p>We can transfer personal data to all  <a href=\"https:\/\/de.wikipedia.org\/wiki\/Liste_der_Staaten_der_Erde#Tabelle\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">States and territories on earth<\/a> as well as elsewhere in the  <a href=\"https:\/\/de.wikipedia.org\/wiki\/Universum\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">universe<\/a>, provided that the law there according to  <a href=\"https:\/\/www.edoeb.admin.ch\/edoeb\/de\/home\/datenschutz\/handel-und-wirtschaft\/uebermittlung-ins-ausland.html\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">assessment of the Federal Data Protection and Information Commissioner<\/a> (FDPIC) or in accordance with a decision of the Swiss Federal Council, adequate data protection and - if and to the extent that the General Data Protection Regulation (GDPR) is applicable - in accordance with  <a href=\"https:\/\/ec.europa.eu\/info\/law\/law-topic\/data-protection\/data-transfers-outside-eu\/adequacy-protection-personal-data-non-eu-countries_de\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Decision of the European Commission<\/a> ensures adequate data protection.  <\/p>\n\n<p>We may transfer personal data to countries whose laws do not ensure adequate data protection, provided that data protection is ensured for other reasons, in particular by appropriate safeguards in the form of standard data protection clauses. Exceptionally, we may export personal data to countries without adequate or appropriate data protection if the special data protection requirements are met, for example the express consent of the data subjects.<\/p>\n\n<h2 id=\"rechte\">5. Rights of Subjects Affected<\/h2>\n\n<p>Data subjects whose personal data we process have the rights under Swiss data protection law. This includes the right to information as well as the right to rectification, deletion or blocking of the processed personal data.<\/p>\n\n<p>Data subjects whose personal data we process may - if and to the extent that the General Data Protection Regulation (GDPR) is applicable - request confirmation free of charge as to whether we are processing their personal data and, if so, request information about the processing of their personal data, have the processing of their personal data restricted, exercise their right to data portability, and have their personal data corrected, deleted (\"right to be forgotten\"), blocked or completed.<\/p>\n\n<p>Data subjects whose personal data we process may - if and insofar as the GDPR applies - revoke any consent they have given at any time with effect for the future and object to the processing of their personal data at any time.<\/p>\n\n<p>Data subjects whose personal data we process have a right of appeal to a competent supervisory authority. The supervisory authority for data protection in Switzerland is the <a href=\"https:\/\/www.edoeb.admin.ch\/edoeb\/de\/home\/der-edoeb\/kontakt.html\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Federal Data Protection and Information Commissioner<\/a> (FDPIC).<\/p>\n\n<h2 id=\"sicherheit\">6. data security<\/h2>\n\n<p>We take appropriate and suitable technical and organizational measures to ensure data protection and, in particular, data security. However, despite such measures, the processing of personal data on the Internet can always have security gaps. Cookies cannot run programs or transmit malware such as Trojans and viruses.<\/p>\n\n<p>Cookies can be stored in your browser temporarily as \"session cookies\" or for a certain period of time as so-called permanent cookies. \"Session cookies\" are automatically deleted when you close your browser. Permanent cookies have a specific storage period. The information is necessary to provide our online offer permanently, user-friendly and reliably as well as to ensure data security and thus in particular the protection of personal data - also by third parties or with the help of third parties.<\/p>\n\n<h3 id=\"zaehlpixel\">7.3 Tracking Pixel<\/h3>\n\n<p>We may use tracking pixels on our website. Tracking pixels are also known as web beacons. Counting pixels - also from third parties whose services we use - are small, usually invisible images that are automatically retrieved when you visit our website.
